Crimpex Product Warranty

Samco Holding (Aust) Pty Limited ACN 143 998 869 (Samco) supplies a range of products to customers under the Crimpex Trade Mark Brand. All products are compliant with Australian regulations and independently certified to respective Australian Standards, Watermark and Gas Regulations.

The Crimpex Water Piping System fully complies with and has been independently certified to, all requirements of Australian Standards AS.

Samco offers a 25 year warranty on its Crimpex Systems and it is backed by a Product & Public Liability Insurance Policy to the value of $20,000,000. The Policy covers claims made anywhere in Australia and New Zealand, for personal injury or property damage caused by faulty products.

Samco’s goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Conditions to ensure Warranty not Breached

This Warranty only applies if:

1. The Crimpex System is selected, configured and installed by a certified licensed plumber, or contractor having the appropriate regulatory licences and having been trained and certified by Samco in the correct installation techniques for the Crimpex System and according to the installation instruction provide by Samco;
2. The Crimpex System must be crimped in accordance with the installation instructions;
3. The Crimpex System must remain in its originally installed location;
4. The Crimpex System must be connected to potable water supply;
5. On inspection the system must show no evidence of misuse, tampering, mishandling, accidental damage, modification or attempted repair without the approval of Samco;
6. The Crimpex System must be installed in accordance with the then applicable Australian Standards and other Plumbing codes;

For the avoidance of doubt, this Warranty does not apply if the Crimpex System fails or results in damage is caused by:

(a) Faulty installation;
(b) The Crimpex System on installation has not been crimped;
(c) The components of the Crimpex System are not manufactured or sold by Samco; and
(d) Chemical conditions or external physical conditions including but not limited to corrosive or aggressive water conditions.
The Warranty against defects provided under this document is in addition to any other rights and remedies you have under a law in relation to the Crimpex System to which this warranty relates.

Warranty Claim Process

To ensure the Warranty is honoured, the Warranty claim process is as follows:

1. You must write to Samco notifying of the alleged failure of, or defect in any Crimpex part or product identified to be sent to:

2. The Proposed Claim must be received by Samco within fourteen (14) days after discovery of the alleged failure or defect occurring within the warranty period.

3. Upon receipt of the Proposed Claim, Samco will contact you to arrange for an inspection of the Crimpex System. The Crimpex System component failure must be
inspected by Samco prior to being removed otherwise the Warranty will be void and the Proposed Claim will automatically be dismissed.

4. If Samco determines that the Crimpex System supplied it has failed or is defective within the scope of the Warranty, then Samco will issue a refund of the purchase price paid and / or repair or replace the defective product.

5. If Samco determines any damage to other property as a result of the installation of the defective product were caused by the direct result of a leak or failure caused by a defect in the Crimpex System, and if you takes reasonable steps to properly mitigate (limit or stop) any further damage resulting from such failure, then Samco may at its sole discretion, reimburse you for your reasonable costs and expenses of repairing or
replacing the damaged property.

6. Samco shall not be liable for any additional costs and expenses including but not limited to relocating and transporting the product, labour, repairs or any other works associated with removing and / or returning filed or defective products, installing the replacement products and damaged personal property as a result of mould etc.

7. In the event that Samco determines that there is no claim for warranty under warranty and you and Samco are unable to resolve the potential dispute of the Proposed Claim between yourselves, the parties must submit dispute to the Law Society of New South Wales Mediation Program prior to any proceedings being commenced. The parties will share the cost of the mediation equally.

8. Should you be successful in a warranty claim, you may recover the costs for anything directly related with the claim on providing the relevant invoices from Samco.
